Terms & conditions

In these terms and conditions ‘Golf Digest Irish Tours’ means Walton Media Limited, a company incorporated in the Republic of Ireland as Company Number 353448 and ‘the Consumer’ means the person availing of any one or more of the services provided by Golf Digest Irish Tours as provided for in these Terms and Conditions.


1. Online Packages

Online packages are intended solely to provide a guide cost for the tour items selected. All tour guide costs are calculated as per person based on double occupancy. Online packages are quoted based on pre-approved accommodations in each category and are subject to availability.


Alternative accommodations may incur an additional cost and the availability of tee times at selected golf courses is not guaranteed until tee times are confirmed to you.


2. Deposits and Payment

Payment is accepted by MasterCard or Visa credit or debit card, bank transfer and bank cheque from certain countries. Laser is accepted for Euro quotations only. An administration charge of 2% is levied against credit card transactions.


A non-refundable booking deposit of 30% applies to all bookings and it is only on receipt of this deposit that the booking is secured. The balance (70%) must be paid in full sixty days before the scheduled date of departure or on the date of booking if the booking is made less than sixty days prior to the departure date.


If the balance is not paid by that date, Golf Digest Irish Tours shall have the option to cancel the booking after communicating with the customer. Cancellation will be subject to a cancellation fee set out below.


All prices quoted are valid for 30 days and may be subject to revision thereafter due to changes in availability or currency fluctuation. Once booked and a deposit is paid, the price of your itinerary in the base currency (Euro/Pound) is fixed and will not change. Price changes will also apply if there is an increase in VAT or taxes by government on services provided.


3. Itinerary & Documents

A detailed itinerary and all necessary travel documents and vouchers will be issued upon full payment of the booking.


4. Cancellations

To minimise your loss in the event of cancellation Golf Digest Irish Tours has a policy of strongly recommending that you have adequate travel insurance. Notification of cancellation must be forwarded in writing via mail or fax to Golf Digest Irish Tours, from the person who submitted the booking form. 


To offer the level of service we provide, we incur overheads and have to pay deposits on facilities, which are for the most part non-refundable. Hence, we have the following cancelation policy in place and are subject to the following per person cancellation charges as a percentage of the total holiday cost.


More than 60 days - 30%
Within 45-59 days of arrival - 50%
Within 21-44 days of arrival - 75%
Within 20 days of arrival - 100%

 

5. Changes to the Itinerary

Where the Consumer wants to alter an aspect of their booking If after acceptance by Golf Digest Irish Tours, the Consumer wishes to alter a holiday, Golf Digest Irish Tours will, where practicable, facilitate the change. A request for alteration must generally be in writing by email or fax and a nominal fee to be advised may be payable. 


Where alterations cannot be made or involve cancellation of accommodation, green fees, air, sea or ground transport previously reserved and confirmed, Golf Digest Irish Tours reserves the right to treat the alteration as a cancellation and cancellation charges will apply.
Substitution by the Consumer - covers a situation where a Consumer who is prevented from actually going on the holiday themselves can transfer the booking to another person.

 

Generally the Consumer is obliged to give Golf Digest Irish Tours a minimum notice of twenty one days in writing of their intention to transfer the booking in advance of the departure date.
The transferee must sign a new Booking Form and comply with any other requirements of Golf Digest Irish Tours applicable to the holiday. A Consumer who transfers a holiday booking shall be jointly and severally liable with the transferee to Golf Digest Irish Tours, for the payment of any balance due in respect of the holiday.

A substitution fee may also apply. Consumers are advised to check their travel insurance and flight details, which in certain instances are not transferable.


6. Unused Portions

In no case will refunds be made for unused portions of booked itineraries.


7. Car Hire

Car Driver must be 21 years of age and have a valid driver's license or international drivers license. Car Hire, includes, unlimited mileage, CDW (collision damage waiver) and V.A.T. (valued added tax). Price does not include petrol/gas, additional driver fee or excess insurance. It is the responsibility of the driver to ensure that they have current driving license valid for a minimum of one year at time of rental. Provisional/Learner drivers or seriously endorsed or disqualified license holders are not eligible to rent a car. At the car hire desk you will be offered the opportunity to buy extra insurance to cover this excess.


8. Compliance

The standard cost letter forms the basis for compliance with the requirements of the package Holiday and Travel Trade Act 1995.


9. Personal Requests - by the Consumer


Personal requests mean, for example, a request for ground floor accommodation or a sea view, etc. Such requests must be communicated in writing at the time of booking. Golf Digest Irish Tours will use reasonable endeavours to fulfill the request. No liability shall attach to Golf Digest Irish Tours for the inability to comply with a special request which has not been confirmed by Golf Digest Irish Tours in writing or which is outside the control of Golf Digest Irish Tours to procure.


10. Disabled Persons - Consumers

Golf Digest Irish Tours will be pleased to help, in whatever way we can, if someone in your group has any special needs, which may be relevant, and which you are obliged to tell us at the time of booking. Golf Digest Irish Tours reserves the right to decline to provide a holiday where in our opinion Golf Digest Irish Tours does not have the resources to meet the requirements of the disabled person.


11. Travel Insurance

Travel Insurance is important: it covers you for everything from medical expenses and luggage loss to cancellations or delays in your travel arrangements, depending on your policy.
If you’re a EU citizen, a European Health Insurance Card (EHIC; available from health centers, or from post offices in the UK) covers you for most medical care. Other countries, such as Australia, also have reciprocal agreements with Ireland and Britain, but many countries do not.


If you do need health insurance, remember that some policies offer lower and higher medical-expense options, but the higher one is chiefly for countries such as the United States of America and Canada that have extremely high medical costs. Everyone should be covered for the worst possible case, such as an accident requiring an ambulance, hospital treatment or an emergency flight home. You may prefer a policy that pays health-care providers directly rather than you having to pay on the spot and claim later.


We strongly advise that you have adequate travel insurance. As Consumers can - due to unforeseen events - be forced to cancel prior to or during their holiday travel insurance provides peace of mind at very little extra cost. Golf Vacations Ireland accepts no liability in the event of a Consumer failing to have adequate coverage of their own is not liable for loss, damage or theft of luggage or personal belongings, or for personal injury, accident or illness.
All cars on public roads must be insured. If you are bringing your own vehicle check that your insurance will cover you in Ireland.


12. Liability - of Golf Digest Irish Tours to the Consumer

Golf Digest Irish Tours shall not be liable for any damage caused to the Consumer by the failure to perform the contract or the improper performance of the contract where such failure or improper performance is due neither to:
The fault of Golf Digest Irish Tours or the retailer acting on our behalf or suppliers of services because the failures occurring in the performance of the contract are attributable to the Consumer.

The failures are attributable to a third party unconnected with the provision of services contracted for or are unforeseen/unavoidable.

The failures are due to unusual and unforeseeable circumstances beyond the control of the organiser/retailer/supplier of services or are due to an event including force majeure which Golf Digest Irish Tours / retailer/suppliers of services could not with all due care foresee or forestall.


Provision is made to compensate the Consumer, for example, for damage other than death, personal injury, damage caused by defamation, damage caused by the willful misconduct/gross negligence of Golf Digest Irish Tours. The compensation is limited to a maximum amount equal to double the inclusive price of the holiday for an adult and for a minor to an amount equal to the inclusive price of the holiday package.

 

If the person claiming the compensation is a person other than the Consumer, such person shall be deemed bound by these Terms and Conditions on the basis that the Consumer was the authorised agent of such person when availing of a service provided by Golf Digest Irish Tours as provided for in these Terms and Conditions.

 

13. Alterations by Golf Digest Irish Tours

If, as a result of force majeure, (that is, any event which Golf Digest Irish Tours or any supplier of services could not, with all due care foresee or avoid, such as closure of course due to bereavement, bad weather or course condition, war or threat of war, civil strife, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions and other similar events outside our control or that of our suppliers) Golf Digest Irish Tours is forced to alter, amend, curtail, change or cancel the holiday the Consumer cannot maintain a claim for compensation. 


Where Golf Digest Irish Tours has specified a minimum number of bookings required for a programme of holidays, Golf Digest Irish Tours obligation to provide that programme shall be contingent on receiving and maintaining that minimum number of bookings. Where the minimum number of bookings is not received up to four weeks prior to the departure date, Golf Digest Irish Tours can amend or cancel or curtail the relevant programme. Golf Digest Irish Tours undertakes that, in the event of having to alter accommodation, golf course or carrier, it will provide a level of service comparable or better at no extra cost. If prior to departure date, Golf Digest Irish Tours alters/changes/curtails, etc. the holiday, which results in more than forty eight hours change in the date of departure or a change in the resort or type of accommodation offered or some other change which fundamentally alters the holiday, Golf Digest Irish Tours shall if practical, offer an alternative comparable holiday.


The Consumer must accept the offer of an alternative holiday within seven days or be subject to refunds as per cancellation conditions. The Consumer should be aware that some suppliers, i.e. carriers, hotels and golf clubs impose cancellation fees/restrictions, etc., which are outside the control of, and for which Golf Digest Irish Tours will not be held liable.


14. Complaints

Golf Digest Irish Tours policy is to react in a positive and courteous manner and to endeavour to resolve to your satisfaction any complaints you may have. We welcome all feedback, positive or otherwise, as we use this information to improve our service to you and all our customers. In the event that you have any reason to complain about your holiday, please notify our representative and the supplier of the service in question so that we can resolve the problem quickly. If you have a complaint after your holiday it must be notified in writing to Golf Digest Irish Tours within 21 days of the end of your holiday. No liability will be accepted by Golf Digest Irish Tours or its suppliers if written notice is not received within 21 days.

 

15. Arbitration

Any dispute or difference of any kind whatsoever which arises or occurs between any of the parties hereto, in relation to anything or matter hereunder or arising out of or in connection with this contract, shall be referred to arbitration under the Arbitration Rules of The Chartered Institute of Arbitrators-Irish Branch.


16. Use of Website

The Consumer agrees and warrants that you are at least eighteen years of age and are legally entitled to use this web site and to enter into this agreement with all the terms and conditions herein, to be financially and otherwise responsible for all use of this web site (including adult and minor members of your family who use this web site in your name or account), that you will not make speculative, false or fraudulent reservations and that you shall only make reservations for yourself or for another person for whom you are legally entitled to act.


18. Disclaimer

Golf Digest Irish Tours or any of its agents or employees, shall not be held liable for; and by accepting these terms the customer waives any claim against all such parties for; (a) any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act or omission of, or any failure of performance of any kind by; any other transportation company; vendor or supplier; (b) any inconvenience, loss of enjoyment, mental distress or other similar matter; (c) any delayed departure, missed connections, substitutions of accommodations, terminations of service, or change in fares or rates; and (d) any cancellation or double booking of reservations or tickets beyond the control of Golf Digest Irish Tours.


Golf Digest Irish Tours does not accept responsibility for losses or additional expenses due to delays or changes, quarantine, sickness, strikes, war, weather, acts of God or other causes. Such losses or expenses will have to be borne by the customer. Cancellation insurance is highly recommended.

 

19. Severability

Each of these Terms and Conditions is separate and severable and enforceable accordingly, and if at any time any provision is adjudged by any court or forum of competent jurisdiction to be void or unenforceable, the validity, legality and enforceability of the remaining Terms and Conditions shall not be in any way affected or impaired as a result.


20. Applicable Law

These Terms and Conditions shall be governed by the laws of the Republic of Ireland
